Former BND chief Hanning arrested on suspicion of treasonous espionage

The arrest

German federal prosecutors on Tuesday arrested August Hanning, who headed the Federal Intelligence Service (BND) from 1998 to 2005. They suspect him of treasonous espionage, obtaining state secrets, attempted treason and espionage. The allegations are unproven, and Hanning has not been charged with a crime that a court has ruled on. He did not respond to Reuters’ request for comment, and the chancellery declined to comment.

According to prosecutors, Hanning agreed in 2010 with a former BND office manager, identified as Manfred D., to receive confidential intelligence in exchange for payment. D. was also arrested and is suspected of having supplied around 2,000 documents over the years, including material meant only for internal BND use and senior-level intelligence briefings at the chancellery. Both men were due to appear before a judge at the Federal Court of Justice.

The foreign intelligence link

Prosecutors allege Hanning used some of this material to prepare an analysis for an officer of a foreign intelligence service and, for years, shared political information with a representative of that agency. They have not named the service, and it was not immediately clear whether the analysis reached its intended recipient. Reuters, citing the Süddeutsche Zeitung, reports that the case does not involve Russia. That is a media report, not an official statement, and the service’s identity and Hanning’s motives remain unknown.

Why it matters

The case adds to a long list of German espionage scandals, and it involves one of the most senior figures the country’s intelligence community has produced. After leaving the BND, Hanning served as state secretary at the Interior Ministry until 2009. It also comes while Berlin is debating expanded powers for the BND, and an allegation of this kind may sharpen questions about how well Germany protects its own secrets.

If the allegations hold, the central issue will be how a former employee could allegedly pass roughly 2,000 documents, some highly classified, over so many years. That would put counter-intelligence and internal security safeguards under scrutiny. BND President Martin Jaeger said the agency launched extensive internal investigations once suspicions emerged and that there can be no compromises on internal security.

What comes next

Investigators must determine what information was passed on, to whom, and how, while ensuring that classified details remain confidential. The government will face pressure from parliament and the public over what it knew and when and over whether current safeguards are adequate. Hanning is also under separate investigation by Hamburg prosecutors over alleged involvement in a failed 2022 attempt to remove children from their father’s custody, and he has rejected those allegations through his lawyer. That case is unrelated to the espionage allegations.
